The Prophet ﷺ said, "When two men both dislike taking the oath, or both wish to take it, let them draw lots for it."Salama said that he was told, "Muamar informed us," and he said, "When two men are compelled to take the oath." He said this concerning an animal for which neither of them had any proof, so the Messenger of Allah ﷺ ordered them to draw lots for the oath.
حدثنا أبو بكر بن أبي شيبة حدثنا خالد بن الحارث عن سعيد بن أبي عروبة بإسناد ابن منهال مثله قال في دابة وليس لهما بينة فأمرهما رسول الله ﷺ أن يستهما على اليمين
[Sahih] Previously mentioned, no. 3616. Ibn Majah also related it in the Book of Judgments, Chapter: Two men both claim a commodity with no evidence between them, no. 2329, from Abu Bakr bin Abu Shayba, through him, and it is found in al-Musannaf: 7/353.
