A Muslim man was on the verge of death in this town of Daquqa and could not find any Muslims to witness his will, so he had two men from the People of the Book bear witness instead. The two came to Kufa and went to Abu Musa al-Ashari, informing him of what had happened and bringing with them the deceased man's estate and will.Al-Ashari said, "This is a matter that has not occurred since the time of the Messenger of Allah ﷺ."So he made them swear after the afternoon prayer by Allah that they had not betrayed, lied, substituted, concealed, or altered anything, and that this was indeed the man's will and his estate. He then upheld their testimony.
حدثنا زياد بن أيوب حدثنا هشيم أخبرنا زكريا
أن رجلا من المسلمين حضرته الوفاة بدقوقاء هذه ولم يجد أحدا من المسلمين يشهده على وصيته فأشهد رجلين من أهل الكتاب فقدما الكوفة فأتيا أبا موسى الأشعري فأخبراه وقدما بتركته ووصيته فقال الأشعري هذا أمر لم يكن بعد الذي كان في عهد رسول الله ﷺ فأحلفهما بعد العصر بالله ما خانا ولا كذبا ولا بدلا ولا كتما ولا غيرا وإنها لوصية الرجل وتركته فأمضى شهادتهما
Its isnad is daif. Bayhaqi (10/165) narrated it from the hadith of Abu Dawud through this route.Zakariya bin Abu Zaida is a mudallis and he narrated it with "an" (without an explicit connective).
