The Messenger of Allah ﷺ ruled that the two disputing parties should sit before the judge.
حدثنا أحمد بن منيع حدثنا عبد الله بن المبارك حدثنا مصعب بن ثابت
قضى رسول الله ﷺ أن الخصمين يقعدان بين يدي الحكم
[Its chain is daif] Ahmad narrated it (4/4) from the hadith of Ibn Mubarak, through this route. Musab bin Thabit is daif due to the weakness of his memory, and Haythami said, "Most consider him daif" (Majma al-Zawaid: 1/25).
