The Prophet ﷺ said, "Whoever sells a slave who owns property, the property belongs to the seller unless the buyer stipulates otherwise. And whoever sells pollinated date palms, the fruit belongs to the seller unless the buyer stipulates otherwise."
حدثنا أحمد بن حنبل حدثنا سفيان عن الزهري
عن النبي ﷺ قال من باع عبدا وله مال فماله للبائع إلا أن يشترطه المبتاع ومن باع نخلا مؤبرا فالثمرة للبائع إلا أن يشترط المبتاع
Muslim narrated it in the Book of Sales, chapter on one who sells palm trees with fruit still on them, hadith no. 1543, from the hadith of Sufyan bin Uyayna with this wording. It is also found in Musnad Ahmad, 9/2.
