She came to the Messenger of Allah ﷺ to ask him for permission to return to her family among Banu Khudrah, since her husband had gone out in pursuit of some slaves of his who had run away, and when he caught up with them at the edge of Qadum, they killed him.She said, "I asked the Messenger of Allah ﷺ if I could return to my family, since he had not left me in a dwelling that he owned, nor any maintenance."She continued, "The Messenger of Allah ﷺ said, 'Yes.'"She said, "So I left, and when I was in the chamber, or in the mosque, he called me, or ordered that I be called, and I was brought to him. He asked, 'What did you say?' So I repeated to him the account I had mentioned about my husband's situation."She said, "He then said, 'Stay in your house until the prescribed term has been fulfilled.'"She said, "So I observed the waiting period there for four months and ten days."She said, "When Uthman bin Affan became caliph, he sent for me and asked me about this matter, and I informed him. He followed it and ruled accordingly."
حدثنا عبد الله بن مسلمة القعنبي عن مالك عن سعد بن إسحق بن كعب بن عجرة عن عمته زينب بنت كعب بن عجرة أن الفريعة بنت مالك بن سنان وهي أخت
أنها جاءت إلى رسول الله ﷺ تسأله أن ترجع إلى أهلها في بني خدرة فإن زوجها خرج في طلب أعبد له أبقوا حتى إذا كانوا بطرف القدوم لحقهم فقتلوه فسألت رسول الله ﷺ أن أرجع إلى أهلي فإني لم يتركني في مسكن يملكه ولا نفقة قالت فقال رسول الله ﷺ نعم قالت فخرجت حتى إذا كنت في الحجرة أو في المسجد دعاني أو أمر بي فدعيت له فقال كيف قلت فرددت عليه القصة التي ذكرت من شأن زوجي قالت فقال امكثي في بيتك حتى يبلغ الكتاب أجله قالت فاعتددت فيه أربعة أشهر وعشرا قالت فلما كان عثمان بن عفان أرسل إلي فسألني عن ذلك فأخبرته فاتبعه وقضى به
Its chain of transmission is sahih. Tirmidhi reported it in the Book of Divorce and Lian, chapter on where a woman whose husband has died should observe her waiting period, hadith 1204, from the hadith of Malik with this chain, and he said, hasan sahih. It is also found in the Muwatta (narration of Yahya), 2/. Hakim graded it sahih, 2/208, and Dhahabi agreed with him. Nasai also reported it, hadith 3562, as did Ibn Majah, 091, hadith 2031.
