I was sitting with the Prophet ﷺ when a man from Yemen came and said that three men from Yemen had come to Ali disputing over a child, having all had relations with the same woman during a single period of purity.Ali said to two of them, "Concede the child to this one." But they refused.Then he said to another two, "Concede the child to this one." But they refused.Then he said to another two, "Concede the child to this one." But they refused.So Ali said, "You are quarrelsome partners. I will cast lots between you. Whoever wins the draw gets the child and owes his two companions two-thirds of the blood-money each."He then cast lots between them and assigned the child to the one whose lot was drawn. The Messenger of Allah ﷺ laughed until his molars, or his back teeth, became visible.
حدثنا مسدد حدثنا يحيى عن الأجلح عن الشعبي عن عبد الله بن الخليل
كنت جالسا عند النبي ﷺ فجاء رجل من اليمن فقال إن ثلاثة نفر من أهل اليمن أتوا عليا يختصمون إليه في ولد وقد وقعوا على امرأة في طهر واحد فقال لاثنين منهما طيبا بالولد لهذا فغليا ثم قال لاثنين طيبا بالولد لهذا فغليا ثم قال لاثنين طيبا بالولد لهذا فغليا فقال أنتم شركاء متشاكسون إني مقرع بينكم فمن قرع فله الولد وعليه لصاحبيه ثلثا الدية فأقرع بينهم فجعله لمن قرع فضحك رسول الله ﷺ حتى بدت أضراسه أو نواجذه

Its chain is daif. Nasai transmitted it in the Book of Divorce, the chapter on drawing lots for the child when they dispute over him, hadith 3519, from the hadith of Ajlah, and Hakim graded it sahih at 3/135–136, from the hadith of Abdul-Razzaq. Thawri is a mudallis, and he narrated with "an" (an ambiguous form of transmission). The hadith has daif corroborating narrations.
