The Prophet ﷺ said, "A previously married woman must not be married off until her consent is sought, and a virgin must not be married off except with her permission."They asked, "Messenger of Allah, what is her permission?"He replied, "That she remains silent."
حدثنا مسلم بن إبراهيم حدثنا أبان حدثنا يحيى عن أبي سلمة
عن النبي ﷺ قال لا تنكح الثيب حتى تستأمر ولا البكر إلا بإذنها قالوا يا رسول الله وما إذنها قال أن تسكت
Bukhari narrated it in the Book of Legal Tricks, chapter on marriage, hadith no. 6970, and in the Book of Marriage, chapter titled "A father or anyone else may not marry off a previously married woman or a virgin without her consent," hadith no. 5136, and Muslim narrated it in the Book of Marriage, chapter on seeking the consent of a previously married woman by speech and a virgin by silence, hadith no. 1419, from the hadith of Yahya bin Abu Kathir, with this same wording.
